Kinda important.
The boring-but-necessary bit.
Draft — not yet approved
This is a structured starting point covering what South African law requires. Effens must review, complete and approve it — ideally with a legal advisor — before the store opens. Placeholders in square brackets need real values.
Who you're buying from
This store is operated by [registered business name], trading as EFFENS, registration number [company registration number], of [registered physical address]. You can reach us at [support email] or [WhatsApp / phone number].
[VAT registration number, if Effens registers for VAT — currently the store is not VAT-registered]
By placing an order you agree to these terms.
Orders
Placing an order is an offer to buy. Our acceptance happens when we confirm your payment and email your order confirmation — that is when a contract exists between us.
If an item turns out to be unavailable after you order it, we'll contact you and refund you in full. We may decline an order where we reasonably suspect fraud.
Prices and payment
All prices are in South African rand and include delivery only where the checkout says so. Your delivery cost is calculated and shown before you pay, so the total you see at checkout is the total you are charged.
Payments are processed by Payfast. We never receive or store your card details. Your order is only confirmed once Payfast confirms your payment to us.
We do our best to keep prices and product information accurate. If an obvious pricing error occurs, we'll contact you before charging you and you may cancel.
Delivery
We deliver within South Africa via The Courier Guy. Delivery timeframes given on our shipping page are estimates, not guarantees — couriers occasionally run late for reasons outside our control.
Risk in the goods passes to you on delivery.
Cancellations, returns and refunds
The Consumer Protection Act and the Electronic Communications and Transactions Act give you rights when buying online, including a cooling-off period for electronic transactions, and the right to return goods that are defective or not as described. Nothing in these terms limits those rights.
Our returns process is set out on the returns page. [The return window, who pays return shipping, and whether refunds or exchanges are offered must be stated here and must meet or exceed the statutory minimum — please have your legal advisor confirm this section]
Products
We photograph our products as accurately as we can, but screens vary and colours can look slightly different in person. Garment measurements are on our size guide.
Your account
Keep your password to yourself and let us know if you think someone else has access to your account. You are responsible for what happens under your login.
Our brand
The EFFENS name, logo, designs, photographs and site content belong to us. Please don't reproduce them commercially without our written permission.
Liability
We are liable for what the law says we are liable for, and no further. We are not liable for indirect or consequential loss. Nothing here excludes liability that cannot lawfully be excluded — including under the Consumer Protection Act.
Governing law
These terms are governed by South African law, and disputes fall under the jurisdiction of the South African courts. We'd much rather sort things out directly first — talk to us.
Changes
We may update these terms. The version that applies to your order is the one published when you placed it.
Draft prepared 30 August 2026. Not in force until Effens approves it.
